Aside from temporary employment-based non-immigrant visas, there are several categories one may qualify for as to non-immigrant status (see this link: Directory of Visa Categories (state.gov).  The most common non-immigrant visas are the Visitor (B1/B2) Visa and the Student Visa (F1).  Knowing and understanding the requirements that must be met to maintain lawful status, or extend your status, in the non-immigrant visa categories is a must.

The US Department of State, through the US Consulates and Embassies, issue non-immigrant visas.  Visas may be valid for many years; however, the I-94 (official DHS Arrival/Departure Record) determines the amount of time you may lawfully stay in the US in your non-immigrant status during any given entry to the US.  This is critical in keeping a client in lawful status, whether for maintaining lawful status, extending lawful status or changing to another type of status while in the US. The I-94 used to be issued on a white card, stamped, and given to the traveler by CBP upon entry to the US; however, I-94s are now issued electronically and the traveler has the responsibility to obtain a copy of it and ensure the validity dates of that visit are complied with (see this link: I94 – Official Website (dhs.gov)).
