Family-based immigration entails a Lawful Permanent Resident or US Citizen filing for an immediate relative (and in some cases, the children of the immediate relative).  The Law Office of Mary Khano Foteh, PC handles both state-side family-based filings as well as consular processing filings.  These types of immigration filings can involve dealing with multiple federal immigration entities, and can also be tricky and time-sensitive.

“Immediate relatives” can include spouses, children under 21 years of age, children over 21 years of age and siblings.  Depending on the immigration status of the Petitioner, wait times can be lengthy.  The US Department of State plays a major role in setting the timing of visa availability in the different categories of immediate relative filings (via the monthly-based Visa Bulletin; see link under our Links & Resources page).  Coupled with backlogs within USCIS, the process can be frustrating.  It is extremely important the case is filed correctly and monitored from start to finish.  Having an organized and detail-orientated attorney aid in this process is crucial.
