Suit Affecting Parent-Child Relationship (SAPCR)
If you have had a child with someone you were not married to, and need orders to be put in place regarding your child, the court must first determine the parent-child relationship through a Suit Affecting Parent-Child Relationship (SAPCR). These orders will set out visitation, child support and the duties of each parent. SAPCRs can also be used to determine and establish maternity and paternity.
There are several ways to prove maternity and paternity in Texas. A mother-child relationship is established by the woman giving birth to the child, a formal adjudication of the woman’s maternity, or by adoption of the child by the mother. A father-child relationship can be established through DNA testing, an effective Acknowledgment of Paternity signed by the father, a formal adjudication by a Court, through adoption, or by virtue of a man consenting to assisted reproduction of his spouse.
